Houston, Texas guns and flower store, called Texas Guns and Roses, is getting sued by the legendary rock band Guns N’ Roses. Say what? This one, I think, is going to be an interesting suit to follow.

HERE'S WHAT WE KNOW

So, Guns N' Roses filed this lawsuit against the Texas gun store on Dec. 1. The lawsuit was obtained by USA TODAY and alleges that the store's name tarnishes the band's by using it without proper "approval, license, or consent." If you ask me, just putting 'Texas' in front of Guns and Roses in the store's name distinguishes it enough. Agree, or nah?

SHOTS FIRED

Now the argument on behalf of the legendary rock band is that GNR "quite reasonably does not want to be associated with the defendant, a firearms and weapons retailer."

The suit goes on to say that the store has political views "related to the regulation and control of firearms and weapons on the website that may be polarizing to many US consumers." Wait, but don’t you guys have a gun, actually two guns, in your logo? Seems a little in the weeds to me.

CHILD, IM CONFUSED

They are also seeking damages to include attorney and court fees.

The business was given 18 days to respond as of Mon. Dec. 5, so there's only a little over 2 weeks left to do so. I mean, what else do you want them to call their gun store? They sell guns, and they sell roses.

Apparently according to reports, once GNR heard about the store using its "likeness" back in Oct. 2019, in Feb. 2020, they had their lawyers send a cease-and-desist letter. Nothing came out of that obviously because here we are.

LEAVE THEM BE

I checked out the business' website, and unless he went in there and did a renovation of the site, it doesn't look like anything other than what it is - a gun store that also sells roses. DNR, let this business live, ok? Is it taking any money out of your already rich pockets? I highly doubt it. They aren't bad mouthing or even mentioning your band or brand at all.

The Houston gun store sells many different types of guns and ammo, as well as four different rose bouquets. They tout themselves as being America’s largest online firearm and accessories store.

Their attorneys say they will be fighting back. "Nobody thinks we’re the band, or there is some affiliation."

Texas Guns and Roses has a registered trademark for the business name as of  2016, after filing two years earlier in 2014.
