People across the state of Texas have been benefiting from a grey area and loophole in hemp law, but legality issues have risen about Delta 8.

According to the Texas Legislature, the production and regulation of hemp became legalized in 2019 with House Bill 1325. While lawmakers thought they covered all their bases, some were left unchecked.

Delta-9 VS Delta-8

The law allows Consumable Hemp Products in Texas that do not exceed 0.3% Delta-9 tetrahydrocannabinol (THC). Fortunately it never made mention of Delta-8, which is a less potent cannabinoid very similar to Delta-9. Like the real stuff, Delta-8 is sold as a flower, concentrate, and even gummies. People often joke that Delta-8 is "light weed" or "diet weed".

Controlled Substances

The Texas Department of State Health Services recently updated the information regarding Consumable Hemp products and now states:

"All other forms of THC, including Delta-8 in any concentration and Delta-9 exceeding 0.3%, are considered Schedule I controlled substances."

What Now?

Some businesses who were profiting from Delta-8 sales are pulling items off the shelf now that language has been updated. Since Texas is extremely conservative, I wouldn't advise risking a possession charge.
