The trial for 6ix9ine's Nine Trey Gangsta Bloods affiliates, Aljermiah "Nuke" Mack and Anthony "Harv" Ellison, is set to begin this month, and when it does, the defense reportedly won't be allowed to reference the rapper's October 2015 sexual misconduct conviction during cross-examination.

According to a report Page Six published on Wednesday afternoon (Sept. 4), U.S. District Judge Paul Engelmeyer ruled that the jury would not hear about the rapper's prior conviction for use of a child less than 17 years of age in a sexual performance. The conviction stems from a February 2015 incident in which 6ix9ine, who was 18 years old at the time, groped a 13-year-old girl on camera while she performed sex acts on two other men. Video of the incident was uploaded to social media, and that eventually led to Tekashi's 2015 conviction.

In a letter, U.S. Attorney Geoffrey Berman had argued that "cross-examination about this topic would be inappropriate because it would be substantially prejudicial" to Tekashi and that it would "cause a jury to unfairly discount [6ix9ine's] testimony due to feelings of disgust." Based on the purported ruling on this matter, it looks like Judge Engelmeyer agrees with that assessment.

In other news from the hearing today, the judge reportedly ruled that snippets from 6ix9ine's "Gummo," "Kooda" and "Billy" music videos can be played as evidence in court. Judge Engelmeyer says "Kooda" includes “misogynistic segments that could be unfairly prejudicial, as well as repeated threats to kill the rival rapper’s mother.”

During the upcoming trial, 6ix9ine, who agreed to cooperate with federal authorities and pleaded guilty to nine federal charges in January, is expected to testify against Mack and Ellison. Ellison is accused of kidnapping the rapper on July 22, 2018. Since 6ix9ine took a plea deal, he will not have a trial of his own.

While Tekashi isn't named in court documents for the case, the witness identified as Cooperating Witness 2 (CW-2) has an October 2015 sexual misconduct conviction, is alleged to have been kidnapped by Ellison on July 22, 2018 and is said to have been managed by Kifano "Shotti" Jordan. All of this information aligns with Tekashi completely, hence the expectation that he will testify when the trial begins later this month.

On June 6, Mack and Ellison were both indicted for criminal involvement in Nine Trey, using and carrying firearms, which were brandished and discharged, in connection with the racketeering conspiracy.

In official court documents, the trial for Mack and Ellison is listed as being set to take place on Monday (Sept. 9).
